Introduction

This Special Airworthiness Information Bulletin (SAIB) is being issued to inform you of confusion over the applicability of Airworthiness Directive (AD) 89-05-02 when it was published in the FAA Regulatory Guidance Library (RGL) around 2000. The confusion affects the following Hawker Beechcraft aircraft models:

A35, D35, E35, F35, G35, H35, J35, K35, M35, N35, P35, S35, V35, V35-TC, V35A, V35A-TC

Background

Recently, the FAA received reports of potential confusion and compliance issues with respect to the applicability section of the RGL version of AD 89-05-02, specifically aircraft serial numbers. The following safety concerns were brought to our attention due to the RGL publication:
  1. Aircraft owners/operators may not have complied with the AD because the affected serial number is not properly identified in the RGL version. (refer to Table 1, Rows 4 & 5)
  1. Aircraft owners/operators could return to service an un-airworthy aircraft and document the aircraft records as complying with the AD.

A correction to the RGL version of AD 89-05-02 was published on September 24, 2008, which removed the line between Rows 4 & 5 referenced in Table 1, which then captured all affected serial numbers. Table 2 shows the updated RGL version that now correctly represents the AD that was originally published in the Federal Register on February 21, 1989.

At this time, this airworthiness concern is not considered an unsafe condition that would warrant an airworthiness directive action under 14 CFR part 39. The original airworthiness action taken by AD 89-05-02 is sufficient to address the unsafe condition identified when it was written.

Recommendations

For those aircraft affected by the applicability confusion over the RGL publication of AD 89-05-02, we recommend you check your records for compliance and take action if necessary.
